Суд идет с конца февраля 2024 года, в заседаниях пока выступают граждане, представленные стороной обвинения: это 210 признанных потерпевшими, 115 свидетелей, приглашенных обвинением. Допросы лиц, представленных стороной обвинения, постепенно близятся к завершению, через некоторое время начнется допрос граждан, представленных стороной защиты. Для ускорения процесса заседания проводятся два раза в неделю.

 

16 и 17 апреля, как и неделю, и две недели назад, на заседании суда выступали признанные потерпевшими. Адвокаты считают, что, как и в звучавших ранее выступлениях, доказательств неисполнения обязательств компанией "Гермес" не было представлено. На одном из недавних заседаний состоялось выступление приглашенного следствием эксперта, анализировавшего документы компании "Гермес", — доктора юридических наук, доцента СПбГУ Ольги Макаровой. Макарова пришла к выводу, что предмет деятельности компании — онлайн-обучение инвестиционной деятельности, а не инвестиции. Компания оказывала клиентам образовательные и консультационные услуги онлайн, продвигала образовательные услуги. Она, согласно договорам, учила клиентов, как вкладывать средства. И средства граждан вносились за оказание консультационных услуг. "Правовая природа договоров — возмездное оказание услуг", — подчеркнула она.

 

При этом есть некоторые пункты договора, которые выходят за его пределы: это пункты о комиссионных, членских взносах и прибыли. Так как компания иностранная, вероятно, есть законодательство той страны, в которой она зарегистрирована, которое предусматривает такие возможности. Возможно, были какие-то партнерские договоры, но эксперту они не были представлены. "По договорам же, которые представлены, исполнитель говорит, что предлагает стратегию и вы можете вложиться туда-то, туда-то, но клиент самостоятельно это делает. Предполагается, что он обучил этого клиента — и давай теперь инвестируй сам. Если клиент попросит, то исполнитель может объяснить и другие юридические действия по управлению активами или иные юридические действия, может быть дополнительный договор по его запросу — но я не знаю, были ли такие договоры", — говорит Макарова.

 

Вопрос процента нигде не указан, исполнитель не гарантирует получение прибыли клиентом. Исполнитель не берет на себя функцию управления активами — он обучает, и отвечать он может только за некачественное обучение.

 

Договоры в электронном виде — это законно, оспорить условия в договоре возможно: "Не скажу, что он сложен для потребителя, все четко расписано".

 

Арест со счетов кооператива частично снят, идут выплаты пайщикам, принявшим решение выйти из кооператива (из почти 20 тыс. пайщиков на 2022 год это примерно 2500 пайщиков), руководство и адвокаты кооператива регулярно отчитываются о выплатах перед судом.

 

Адвокаты отмечают, что в последние месяцы проявляется активность одной из групп в телеграме, которая даже стала представляться от имени кооператива, создала "альтернативную" электронную почту кооператива. Адвокаты, совет и правление кооператива рекомендуют пайщикам по всем вопросам обращаться на официальный сайт, в официальный телеграм-канал и официальный чат для пайщиков кооператива.

The new study’s revised family tree for crocodilians offers fresh insights into climate resilience in the group, and hints at how some species adapted to environmental cooling while others went extinct. With salt glands allowing Deinosuchus to travel where its alligatoroid cousins couldn’t, the terror crocodile settled in habitats teeming with large prey. Deinosuchus evolved to become an enormous and widespread predator that dominated marshy ecosystems, where it fed on pretty much whatever it wanted. “No one was safe in these wetlands when Deinosuchus was around,” said senior study author Dr. Marton Rabi, a lecturer in the Institute of Geosciences at the University of Tubingen in Germany. “We are talking about an absolutely monstrous animal,” Rabi told CNN. “Definitely around 8 meters (26 feet) or more total body length.”
