Станом на 2003 рік 775 га земель в межах Хотівської сільської ради Києво-Святошинського району Київської області знаходились у користуванні відокремленого підрозділу Національного аграрного університету «Боярська лісова дослідна станція». В 2008 році Києво-Святошинська районна державна адміністрація звернулася до Національного аграрного університету з листом про надання згоди університетом та Боярською лісовою дослідною станцією на припинення права постійного користування частиною цих земель в розмірі 12 га з цільовим призначенням ”для ведення лісового господарства”. У відповідь вчена рада аграрного університету погодилась вилучити з постійного користування Боярської ЛДС цієї ділянки. На підставі цього листа Києво-Святошинська РДА в лютому 2010 року прийняла розпорядження — припинити право постійного користування Боярської лісової дослідної станції частиною земельної ділянки площею 12 га та віднести її до земель запасу Хотівської сільської ради. І ось це розпорядження, з якого земля перестала бути державною, за оцінкою слідства, є незаконним, бо, згідно зі статтею 142 Земельного кодексу України, Києво-Святошинська РДА не була власником земель державної власності лісогосподарського призначення, аби приймати по ній якісь рішення. Згідно законодавства, вилучення лісових угідь площею більше 1 га може відбуватись лише на підставі рішення Кабінету міністрів України, якого в даному випадку не було.
